life insurance death benefits?
My father passed away a couple of months ago. my mother is asking me for help in filling all legal docs, etc. I do not have a clue about this stuff and she is so gullible it scares me. Is there some one available for hire to assist her that will not take advantage of her?
bankers life insurance company will not send her a life insurance check without coming to her home. She told them she needs the money and is not interested in buying anything or putting the money into another account of some type. She has provided bankers life with all the necessary paper work. Why are they giving her a hard time? I do not have time to be there for her every move. She is physically and mentally capable, but has trust for anyone.
She and/or you need to hire an estate attorney. A good one will help you take care of everything associated with your fathers death.
Bankers Life is primarily an annuity company so I'm not surprised that they might try to convince her to buy an annuity with the life insurance benefit. I wonder if she went through the agent from Bankers that sold her the policy. He may be trying to get her to put her life insurance proceeds in an annuity or something so he can get another commission. You may need to contact the company directly and just tell them to send the lump sum or she will get your state department of insurance involved. If she has already filed the claim she just needs to tell the agent to back off and the company to send her money.
i would hire a lawyer and have them (the bankers) meet her in the presence of a layer or legal person.
If you can't afford one ask one of her friends or other relatives to be there and support her when they come to her house. Make sure she has someone there who will back her. Sorry about your father.. good luck!

Whatever happens see if the insurance company can place the money into a bank account of their subsidiary banks. That way your mother can begin writing checks on the account immediately. Usually they set this up and some checks are expressed mail to the beneficiary. Otherwise they will just send your mother a check and her bank will not allow her to write checks on that amount for about 30 days. I learned this the hard way.
I wouldn't hire a lawyer until I was obvious the insurance has no plans to pay out. Been there done that too. Lawyers can rack up charges faster than a lap dancer.

I agree with the first person who answered this question. I would also inform Bankers Life that if they do not issue the check because all of the correct paperwork has been filed you will report them to not only the BBB but also the department of insurance in your state, and have them investigate why they are not paying the claim. You do not need a lawyer. Your State Insurance Commissioner's Office can get the ball rolling for your mother. Just call the Dept of Insurance and ask for the consumer complaints department.

She could hire an attorney to take care of settling the estate.
If there's a real live policy, they do not HAVE to come to her home. I'd have her have them put it in writing, then she can file a complaint to the state insurance commissioner.
Unless they strongly suspect that someone will forge her name, and try to steal the money from her. That's the only thing I can think of.

You do not need an attorney. If they need to witness her signature she can probly go to an agents office for them to witness it.
And, it is a good idea for her to have the company to put the money into a checking account for her so she can start writing checks against her new checking account. Most life insurance companies now offer this service. It is usually FDIC insured but I would ask and make sure.
It could be they wanted to come to her home if she could not make it to one of their offices. If that is the case then have some friend or relative there when they come. Sounds o.k. to me. I would offer the same kind of service. But make sure it's an insurance agent that comes to the door. Ask for a business card and to see their license.
Be careful of scams. And, of course you can also check with your state's Department of Insurance.

It is highly unlikely that the agent is trying to sell you something else. But, if that were the case you can just say your not interested. Taking their checking account is usually a good idea because they can transfer the money right away and you can start writing checks on the account. There are no charges (check with the company) usually for having the checking account.
And, sorry this is so long, but a couple of months? Usually insurance companies send you a check within the first week. Obviously they are either waiting for the death certificate or your mom to sign those forms. They probly have been waiting for 2 months for those items. No wonder they want to come out and see her. They really want to get this claim settled. Maybe Bankers Life does not have all the paperwork. I would call them and ask them. If they do have everything I would tell them to send the check today or you will file a complaint with the insurance commissioner. I bet they do not have everything that they need. Give them a call.

Finding someone you and your mother can trust is something you have to consult with friends and relatives, and I hope for you, you will find someone. Otherwise – you are the person to be trusted.
The second question regarding Bankers Life Insurance Company: look at the situation without emotions. If Bankers Life want to bring the check in person, and will not send your mother the life insurance check without coming to her home – let them come, make sure you are present when they come, take the check, and the issue is closed. Why complicate the situation?
You may not like it, but it makes sense, and simple. You are already hurt with your personal loss, and no check can correct that. Be strong enough and put an end to this affair with the check.

You don't need a lawyer. Tell her to tell them to mail it. She's under no obligation to meet with them or sign anything once the claim form is filled out. If the local office is telling her that then call the main company and complain. If they also insist tell her not to let them in and meet them at the door. She's a big girl.
