If auto insurance is required by law?
If liabilty insurance is required by law for all drivers, then why aren't uninsured drivers made to pay for the damage they cause in an accident even if it is out of his own pocket? Why does the insured driver's insurance have to cover for the uninsured driver? Why is it almost treated as though the uninsured driver is no longer liable because the other guy has insurance?
Also, did you ever see those auto insurance commercials where some person is claiming they are driving without insurance because they can't afford it or because they have a bad driving record. In other words, we are supposed to accept drivers who think they don't have to obey the laws because they can't afford it or think that wreckless drivers are cute and funny and have to feel sorry for them.
Get insured, choose a vehicle with lower insurance premiums have the cash to cover any damage or get off the road!!
Ever hear the expression, "You can't sqeeze blood out of a turnip?"
That's why uninsured motorist don't pay for damages.

If they have collateral (like a house) , you can sue them and put a lien on their property to get them to pay you or you can garnish their wages. Still, this is no excuse to drive without insurance and I agree…if you can't afford to be insured, you can't afford to be on the road either.

Uninsured drivers do get sued. Your insurance company covers you first, because, if you had $20,000 damage done by an uninsured driver with an 85 K-Car, and $19 in the bank, you could be waiting 5 years. Believe it or not, I know of one person paying off over $3,000,000 in uninsured liability debts. She will never get it paid, off, will never own a house, never own a new car, unless she wins a lottery larger than her debt. If that was owed to you, you were permanently handicapped, would you want to wait for her to pay you, or would you want your insurance to cover it and sue her?

Not sure what happened to bring on this rant but let me clear up a few things for you.
1) Insurance is not required in all states, Wisconsin for example does not require auto insurance. However, they do require the driver to be held responsible for the damages they cause.
2) If you are hit by an uninsured driver and collect from your own company they WILL go after the uninsured party to get back your deductible and the money the company paid.
3) If you don't have collision coverage then you have the right to sue the uninsured person and get a judgment against them.
I own a company that insurance companies hire to collect these claims back from uninsured people. The process is called subrogation. Trust me most companies want to collect the money back.
A person who causes an accident while uninsured faces a bunch of things that will hopefully teach them to buy insurance.
- They will lose their Drivers License if they have one. In most states that we do business in if we get a court judgment against them they lose their drivers license for 20 yrs or until they pay the debt.
- They have to make monthly payments to repay the damages. Depending on the amount owed some folks owe us $200 per month for 10+ years.
- We get to add court costs to the original debt.
- We get to add up to 12% interest to the debt. (in some states)
- A court judgment on their record keeps them from being able to get approved for a car or house loan. I have even had a couple of people get turned down for cell phones due to judgments we have gotten against her.
We try to do everything we can to hold these people responsible for the damages they cause and so do most insurance companies.

Owner of a subrogation recovery company.
Financial responsibility is required in ALL states. That can be a $300k bond, an automobile policy, etc… but something -IS- required… not just a promise to pay of you cause someone a loss.
The best weapon against people diving without insurance is from the state where the accident happens. Some will not allow those people to collect for their property damage if it's caused by someone else and they themselves don't have insurance ("No Pay, No Play laws). Most other states -will- suspend the uninsured person's drivers license until they can show proof that the loss was settled. Unfortunately most insurance companies don't pursue recovery very aggressively as it cost too much money and they are not in business to make social changes.
Don't like it… voice your opinions to your state politicians. if you don't do this and your letting it go on.
